7. What's Missing: The Gap Between Built and Paid, Renewed, Referred
Assumption: nothing is built yet. These are the gaps between the plan and a business. They're written for the DACH-agency fallback, because the generic version has no path to close them.
7.1 Gaps to pay
| Gap | Why it blocks payment | Fix |
|---|---|---|
| No reason to switch | Web3Forms, Formspree and Netlify already work, and several are free | Sell only to agencies whose clients ask where form data goes. Lead with EU-only processing plus client handover. |
| No defined buyer | "Static, no-code and AI-built sites" is three markets, each served | DACH web agencies building Astro, Hugo, Next.js, Framer or AI-built client sites. One language, one buyer. |
| Pricing | Undefined. The anchors are brutal: $5 (splitforms), €4.99 (Formdall), free (Netlify). | Free (1 site, 100 submissions, testing only) → Freelancer €9 (5 sites) → Agency €39 (25 client sites, white-label, per-client AVV annex) → Agency Plus €79 (100 sites, client read-only inboxes). Annual = 2 months free. No lifetime deals. |
| No trust signals | Agencies stake client relationships on you | Named EU subprocessors, AVV, TOMs, an imprint (Impressum) with a real German or EU address, a status page and a named founder. |
| Payment and VAT | Selling to EU businesses needs correct VAT handling | Use a merchant of record (Paddle or similar) and collect VAT IDs. |
7.2 Gaps to renew
| Gap | Fix |
|---|---|
| Set-and-forget product. Nobody logs in, so nobody notices value until renewal. | A monthly per-client report the agency can forward: submissions received, spam blocked, delivery rate. |
| Low switching cost for one-site buyers | Grow per-agency site count. Every client site wired in adds a day of rework to leave. |
| Project churn (a freelancer's client project ends) | Push agencies onto annual plans. Price by site count, not submissions. |
| Silent failure (notifications in spam) | Delivery monitoring per workspace, with an alert when a client domain's authentication breaks. |
| The DPF question | If the pitch rests only on "EU-only", a pro-DPF ruling weakens renewals. Make client handover the second reason to stay. |
7.3 Gaps to refer
| Gap | Fix |
|---|---|
| White-label hides your name | Keep an opt-in "form by FormDrop" link on the free plan only. Paid plans stay clean. |
| No agency community | Show up where DACH agencies meet: local meetups, Astro and Framer community channels in German, agency Slack groups (specifics unverified). |
| No referral economics | One free month per referred paying agency. |
| No free hook | A free German "Kontaktformular-Check": paste a URL, see where the form sends data and which third parties it loads. |
7.4 Non-product gaps
Distribution
- This is the whole problem. The idea has no answer to "how do people find you?" that the incumbent and ten entrants don't already use better.
- Channels that could work for the fallback: outbound to agencies (hand-built lists, personal emails, calls), German long-tail content, a white-label deal with an EU host or agency network, and paid migrations off US form backends.
- Channels that won't: English SEO, Product Hunt, "Lovable contact form" guides, and paid ads to developers.
Positioning
- Current: "form backend for static, no-code and AI-built websites". Generic, and already claimed by ten others.
- Better (fallback): "Kontaktformulare für Kundenprojekte: Server in der EU, AVV pro Kunde, Benachrichtigungen im Namen Ihres Kunden." (Contact forms for client projects: EU servers, a DPA per client, notifications in your client's name.)
Sales motion
- Founder-led outbound for the first 50 agencies. A 15-minute call, then a hand-configured first client site.
- Self-serve after that, with German docs.
Compliance and legal
| Area | Requirement |
|---|---|
| GDPR / DSGVO | You're a processor. AVV (Art. 28), subprocessor list, TOMs, breach-notification process, deletion on schedule. |
| International transfers | Keep every subprocessor that touches submissions in the EU/EEA. Note that Cloudflare in front of an EU server is still a US company in the data path; decide and disclose. |
| German marketing law | No "DSGVO-konform" guarantees. An imprint (Impressum) and a privacy policy in German. |
| Email law | Notifications go to the site owner, not to marketing lists. Autoresponders must not carry advertising. |
| Abuse | Terms that ban phishing and spam relays, with enforcement: verification, field detection, suspension. |
| Taxes | EU VAT via a merchant of record. |
| Insurance | Professional indemnity or cyber cover (cost unverified). |
Team
- Not provided. Needed at minimum: one developer comfortable with email deliverability, and German fluency (the founder or a paid partner). Without German, the fallback doesn't exist.
Metrics and instrumentation
- Paying agencies, sites per agency, blended ARPA, monthly revenue churn, notification delivery rate, spam-block rate, share of signups from outbound vs search, abuse reports per month.
